      Virginia Traffic Lawyer

Were you recently ticketed for speeding, reckless driving, or some other traffic offense in Northern Virginia?  If so, speak to an experienced traffic lawyer today because Virginia treats traffic offenses very seriously.  Even if you ultimately decide not to retain an attorney, a qualified traffic lawyer can advise you of what to expect in traffic court and what a likely outcome in your case is.

Reckless driving is a common charge in Virginia.  If you are cited for going 20 or more miles per hour over the posted speed you will be cited for reckless driving in Virginia.  Reckless driving in Virginia is a Class 1 misdemeanor criminal offense and should be taken seriously.  Our Virginia traffic attorneys can represent you in court if you’ve been charged with reckless driving.

Other serious traffic offenses, such as speeding, driving on a suspended license, driving without a valid license, and DUIs are also very common in Virginia.  In fact, people receive speeding tickets in Virginia everyday and they can be costly.  Justin Ervin has successfully represented numerous clients against Virginia speeding tickets.  We understand the laws and can help ensure all your legal rights are protected.

      Experienced Fairfax Traffic Lawyer

While we have experience working with clients facing traffic charges throughout Northern Virginia, including Arlington, Alexandria, Loudoun, Stafford, and Prince William counties, we specialize in Fairfax traffic defense.  When you are facing a drunk driving charge or any motor vehicle traffic offense, you need fast, accurate answers about your situation and the best way to proceed. The defense attorneys at Ervin Kibria understand your concerns and your sense of urgency in dealing with a difficult situation.

Many traffic tickets are considered moving violations. As a moving violation, DMV demerit points will be assessed in accordance with the type of conviction. For example, if you have a good driving record, such as +3 record, and are convicted of a speeding ticket at 74 mph in a 55 mph zone, the 4 points that would be assessed would result in a -1 point balance. In addition, most insurance companies raise their rates when their customer receives a moving violation, such as a speeding ticket, because the customer is deemed to be a greater risk for the insurance company.  As a result, it is strongly recommended that you contact an experienced traffic lawyer at Ervin Kibria to discuss your available options.

      Virginia Traffic Demerit Points

What are the Traffic Ticket Points and Penalties?

Upon a conviction for a traffic offense, the Court sends notice of the conviction to the Virginia DMV.  In response, the DMV will issue demerit points according to the severity of the offense, including offenses that are incurred out of the state.  Depending on the type of charge, the conviction will remain on the driving record for a certain period of time.

      Traffic Ticket Points

      3-point violations:

      • Speeding 1-9 mph above the posted speed limit (5 years on driving record)
      • Improper passing (3 years)
      • Improper turn (3 years)
      • Violation of right turn on red (3 years)
      • Driving without lights/excessive lights (3 years)

      4-point violations:

      • Failure to yield right-of-way (3 years)
      • Following too closely (3 years)
      • Improper signal (3 years)
      • Passing stopped school bus (non-reckless)(3 years)
      • Failure to obey traffic signal (3 years)

      6-point violations:

      • Speeding 20 mph or more above the posted speed limit (5 years)
      • Reckless Driving (11 years)
      • Driving While License Suspended (11 years)
